Your privacy is very important to Accolade, Inc., and its affiliates, including Accolade 2ndMD LLC (“Accolade Expert MD” or 2nd.MD”) (collectively, “Accolade”). This “Privacy Notice” has been compiled to assist you in understanding the ways in which we, Accolade, collect personal information from you as you use the www.accolade.com or www.2nd.MD websites (the “Site(s)”). We are here to help you understand your healthcare options, to facilitate your use of the healthcare system and to support you as you make your healthcare decisions. The content we provide you is for informational purposes only, is based on the best available information, and may not be relied upon when alternative and more relevant information (such as, for example, information provided directly by your healthcare provider) would be more relevant or accurate. No material contained within or provided through the Accolade and 2nd.MD Sites should be construed as medical advice and/or treatment. Those digital services are just one more way you can connect with your Accolade Health Assistant® representative to support you and your family in your healthcare journey.  This Privacy Notice applies only to your use of the Site, and was last updated as of the “Last Updated” date at the top of the policy. Accolade may revise this Privacy Notice at any time and such revision will be posted here and accessible at the following link: 2nd.MD/privacy/general. Any revision and/or addition to this Privacy Notice shall become effective and binding on you when you continue to use the Site on or after the effective date of such revision and/or addition.  

2. What Information Does Accolade Collect Through the Site? 

Accolade collects certain types of information from you, whether you provide it directly or it is automatically gathered as you use our Site.

5. How Do We Protect Your Information?

We follow industry standard practices to protect, secure and maintain the integrity and availability of your information. The Site and our internal networks supporting the Site are scanned regularly for malware and other viruses. Notwithstanding the foregoing, you acknowledge that no security safeguards or method of transmission over the Internet are completely secure. 

The Site is not intended to collect, maintain or transmit your information to the privacy and security standards used in healthcare or banking where sensitive medical, health, or financial information may be transmitted. The Site is not protected according to HIPAA/HITECH, PCI or other such standards. DO NOT USE THE SITE OR COMMUNICATION TOOLS TO SEND US SENSITIVE PERSONAL OR PROTECTED HEALTH INFORMATION (e.g., do not send us your health information, benefit or ID card number, health claims information, social security number, financial account number, passcodes, etc.). For this reason, Accolade does not secure the transmission of your information submitted through the Communication Tools (as defined above), including using the addresses and numbers provided in the “Get in Touch” section of the Site. 

6. How Long Do We Keep Your Information?

We store your information for as long as necessary to serve the business purposes for which it was collected and in conformance with applicable data protection laws. When determining how long we keep your information, we consider factors such as, but not limited to, the type and sensitivity of the data, the risk of unauthorized use, the purposes for processing, and the legal or business needs. Due to our data protection measures, residual copies of your information may temporarily remain in our backup systems before being automatically deleted or rendered inaccessible. 

7. Does the Site Use Cookies?

Yes, the Site uses “cookies” and other web tracking tools. We may store information about you using the cookies on our site. A cookie also called web cookie, Internet cookie, browser cookie, or simply cookie) is a small piece of data sent from a website and stored on the user’s computer by the user’s web browser while the user is browsing. We use cookies to improve your site experience, to assess content usage, to distinguish you from other users of our site and to support the marketing of our services. For example, cookies help determine what kind of content we will serve to the user – a use case might be, if a user is browsing a particular set of page content themes, we might serve that theme in the form of advertising as we’ve identified them as an interested party of that theme.

Please note that by deleting our cookies or disabling future cookies you may not be able to access certain areas or features of our site. 

8. What Are the Privacy Policies of Third-Party Websites to Which the Site Links?

Occasionally, at our discretion, we may link to third party sites or content on the Site. These third-party sites have separate and independent privacy policies. We, therefore, have no responsibility or liability for the content and activities of these linked sites. 

Nonetheless, we seek to protect the integrity of our Site and welcome any feedback about these third-party sites. We urge you to review the privacy policies posted on these third-party websites at the time you first visit such sites. 

9. Where Does Data Storage and Processing Occur?

The Site collects information and processes and stores that information in databases located in the United States. If you are visiting the Site from a country outside the United States, you should be aware that you may transfer personally identifiable information about yourself to the United States, and that the data protection laws of the United States may not be as comprehensive as those in your own country. By visiting the Site and submitting any personally identifiable information you consent to the transfer of such personally identifiable information to the United States. 

10. State Data Privacy Law Exemptions

Accolade and its affiliates are exempt from the Connecticut Data Privacy Act (“CTDPA”), Utah Consumer Privacy Act (UCPA) and Virginia Consumer Data Protection Act (“VCDPA”), and other similar state data privacy laws, with the below stated exemptions, which grant residents specific rights concerning their personal information. 

These state laws  generally apply to for-profit and business-to-business companies that interact, or process personal data of these states on a relatively larger scale. However, these laws DO NOT apply to covered entities or business associates under the Health Insurance Portability and Accountability Act (“HIPAA”) and the Health Information Technology for Economic and Clinical Health Act. Accolade and its affiliates are covered entities and/or business associates and are not subject to CTDPA, UCPA, VCDPA or any other state data privacy laws with similar exemptions.  

11. Additional Terms for EU Visitors

This website is intended only for users located in the United States. To the extent that you are accessing this website from a location within the European Union, the following information shall apply to the collection and processing of your Personal Information. 

The data controller for this Site is Accolade, Inc. Accolade processes Personal Information it collects through the Site for Accolade’s legitimate business purposes, for example to fulfill any requests you may make in connection with your submission of personally identifiable information, to monitor and improve the quality of the Site, and to protect and defend our rights, property or safety or that of our clients and other users of the Site. You may have the right to access and/or obtain a copy of your Personal Information, correct inaccuracies in your Personal Information, request the erasure of your Personal Information and restrict the processing of your Personal Information. For more information about how you can access, rectify, and erase your Personal Information or make any other requests relating to your Personal Information or to contact Accolade, please see the “Contact Us” section of this Privacy Notice below. 12. Does the Site Use Other Third Party Tools, such as Google AdSense?

Accolade has enabled Google AdSense on the Site. Google AdSense is an advertising service provided by Google. Accolade uses the “DoubleClick” Cookie, which tracks use of www.accolade.com, 2nd.MD, and user behavior concerning ads, products, and the services we offer. 13. Session Replay Technology

You acknowledge that Accolade uses session replay technologies, such as those provided by Quantum Metric and FullStory, that employ software code to record users’ interactions with the Services in a manner that allows us to watch and analyze visual reconstructions of those user sessions. The replays may include users’ clicks, mobile app touches, mouse movements, scrolls, and keystrokes/key touches during those sessions. These replays help us diagnose usability problems and identify areas for improvement. 14. Electronic Mail from Accolade

When you provide your email to Accolade by using the Communication Tools (as defined above), you can select to opt-in to receive email from Accolade. If you opt-in to the receipt of this electronic mail, we will: 

  • not use false or misleading subjects or email addresses; 

  • identify the message as an advertisement in some reasonable way; 

  • include the physical address of our business or site headquarters; 

  • monitor third party email marketing services for compliance, if one is used; 

  • honor opt-out/unsubscribe requests quickly; and 

  • allow users to unsubscribe by using the link at the bottom of each email 

You can unsubscribe from promotional emails at any time by: (1) following the unsubscribe instructions in our emails; or (2) emailing us at [email protected]. You may update your email preferences anytime as well. Please note that even if you unsubscribe from promotional email messages, we may still need to contact you with important transactional information related to your account and your use of the Service. For example, even if you have unsubscribed from our email messages, we will still send you emails relating directly to a profile created through the Service confirming registration.
